The EU AI Act for marketers: what applies from 2 August 2026, and what the Omnibus delayed
Chatbot disclosure and AI-content labelling apply from 2 August 2026; high-risk rules moved to December 2027. What marketers and agencies must do now.
Default AI setups favour convenience: public APIs, raw data sent out, little logging. Secure deployment makes a deliberate choice at every layer.
The short answer
Secure AI deployment means sensitive data runs on local or private models, anything sent to a public model is masked first under enterprise zero-retention terms, and every request and decision is logged. Deletion on request is built in, as the UAE Personal Data Protection Law (Federal Decree-Law No. 45 of 2021) expects.
The main attack is well documented: prompt injection is ranked first (LLM01) in the OWASP Top 10 for LLM Applications 2025. The UAE’s data law, Federal Decree-Law No. 45 of 2021, applies to personal data processed in the UAE whether the processor is local or abroad.
Use of AI is near universal now: nearly nine in ten organisations in McKinsey’s 2026 survey use it in at least one function, so the question is how, not whether.

For a Dubai luxury services business:
An AI system designed so data doesn’t leak, decisions can be audited and the setup meets your legal obligations, rather than one that simply calls a public API with raw data.
It depends on the workflow. Use local models where data control matters most and public models where capability matters most, often within the same system.
A lawful basis for processing, clear notice, data minimisation, appropriate security, rights of access and deletion, and care with cross-border transfers. See private AI under the PDPL.
They can be part of a secure design: enterprise zero-retention terms, masking before every call, logging, and clear rules on what may leave your environment. Where even masked data can’t leave, local models are used.
Prompt boundaries, output filters, escalation to a person when confidence is low, and logs. The goal is fewer failures and fast detection, not a promise of none.
